If it's a fake Photoshopped image, which it sounds like it is to me, it's actually someone else's work – so as weird as it sounds, you couldn't use it at all!

Alright, so this is a fun situation:
If it's real and just not out yet, you can't use it until USUM are released in a couple of weeks, then it acts like a normal Pokémon.
If it's a real unused beta Pokémon, you can use it and it counts as a fan-made Pokémon, so you can use it in fics and in...
You'll have to be a bit more specific – what precisely are you trying to use, and where? Is it the same thing we were talking about before – using your own fan-made based on an unused beta Pokémon – and would it be in fic or RP?
Whereas you suggest that Sylvie should own everything in her RP because she started it, I must say that that rule would be impossible to enforce – the other RPers own their pieces of the RP, and Sylvie's contribution – beyond her words and characters – is generic enough that I wouldn't be able...
The same goes for the school concept here – Sylvie can't claim ownership of the idea because she didn't think of it. I can probably link you two dozen high school or college RPs on this site alone. To use your analogy, it's like buying a car and then demanding no-one else drive any car the same...
The kicker in this case is that logically, I can't enforce a "whomever first uses a concept gets exclusive rights to it" rule. If that were the case, whomever first ran a "fight gym; get badges" RP would be the sole owner of the concept and I'd have to ban anyone else using it – which is silly...
Obviously, I wouldn't allow an RP set in an original universe or unique concept to continue, nor would I allow people to auto other characters without permission. Both would be taking ownership of another writer's ideas.
Role playing is inherently collaborative. I like to describe our approach to it as "collaborative novel writing." This means that to some extent, the RP is collaboratively "owned" by everyone who joins in – Sylvie might own her work, but she doesn't own anyone else's. If they decide to take that...
Let’s make this a little simpler - what would you prefer we do in this instance? Would you like us to stop other people using the idea from that RP thread? I ask because I think logically, so having a goal in mind will help me understand the issue better.
